A major trade secrets lawsuit has been filed against SAP, the German software giant, by its US-based competitor, o9 Solutions. The lawsuit alleges that SAP stole confidential information related to supply chain management software, a move that could shake up the industry.
But here's where it gets controversial: o9 claims that SAP hired away three of its top executives based in the Netherlands, who then took with them a staggering 22,000 confidential files. These files, according to o9, contained sensitive technical, marketing, and sales data about their supply chain software.
And this is the part most people miss: o9 believes that SAP used this stolen information to enhance its competing software, effectively trying to muscle o9 out of the advanced business planning solutions market.
In a statement, o9 CEO Chakri Gottemukkala said, "The evidence of SAP's coordinated attack on o9 is clear and compelling."
The lawsuit further alleges that SAP's new software version, introduced after losing customers to competitors, "closely mimics" o9's products. o9 argues that SAP is attempting to copy their platform architecture, capabilities, and even their product messaging strategies.
o9 is seeking a court order to prevent SAP from misusing its trade secrets and is also requesting unspecified monetary damages.
The case, o9 Solutions Inc v. SAP SE, is currently in the U.S. District Court for the Northern District of Texas (No. 3:25-cv-03245).
